These are our terms of service (use), and they apply to all users of the platform. “We,” “our” or “us” refers to The Battle Lab, LLC and our subsidiaries. “TBL” refers to this platform and the services offered by us. By using TBL you agree to these terms and to the other policies we post. Please read them carefully and let us know if you have any questions. For information about our data practices, please see our Privacy Policy. We can collect and use your information in accordance with those policies.
When you create an account, you must provide us with accurate information, in good faith, and you agree to keep that information updated should it change. To create an account, you must be at least 18 years of age. To purchase an item from us, you must also agree to the terms of service and use from our third party service providers and payment gateways. Please review our Privacy Policy for more information.
You are responsible for your account. This means it’s your responsibility to ensure the security of your account by using strong passwords. Likewise, you are also responsible for the content you provide, share and post on our services and platforms. Should you feel your account is compromised, please contact us immediately.
You can’t create fake pages, or accounts, or collect money for things you’re not actually doing.
You cannot pretend to be or impersonate someone else by using the name, brand or works of another to deceive anyone.
You also can’t use TBL as a prank or to fund non-activity. For example, you can’t collect funds for *not doing* something, such as “I will stop posting videos to YouTube of me playing the piano horrible if I get $300 in donations.”
Our community guidelines exist to shape and guide us and our participants and patrons of our services and platforms. This is not about building an arbitrary framework of “right vs. wrong.” It’s about making TBL a place where diverse people can come together and share, while still allowing for different, and sometimes conflicting points of view. That said, respect others, and their view point. We encourage member interaction to create a healthy dialog.
It’s also important to note that some of our content, and content created by others may be sensitive in nature. This includes violence, nudity and other adult situations. This being said, we will not tolerate blatantly obvious pornographic content, offensive and graphic content depicting violence, assaults, murder, illicit and illegal behavior. We have an absolute zero tolerance policy when it comes to sexual violence, which includes bestiality, rape, and child exploitation.
We recognize that discussing celebrities, media, events, news or other public figures can sometimes involve harsh criticism, and we believe that is an appropriate part of free debate. However, we draw the line when it comes to harassing private figures, or taking any action that might affect people’s physical safety, regardless of whether these people are private or public figures.
As much as we want you to be able to express yourself, we want all of our users to have the right to express their opinion without feeling intimidated. Even the most difficult conversations should take place in the most respectful way. Here is how we define these behaviors.
BULLYING
You cannot attempt to intimidate anyone, either directly or by using your influence over others. We treat real-life interactions more seriously than online interactions when analyzing whether a line has been crossed because it can be more threatening and lead to physical violence. When both sides engage in similar behavior, such as feuds between public figures, we are less likely to take action, but it doesn’t preclude inaction.
THREATS
Anyone on our platforms should be able to express their opinion in a way that doesn’t threaten another person. In this fashion, we take threats of violence very seriously. Any member threatening the well-being of an individual or group of people will be removed. This includes threatening behavior such as stalking or inciting others to commit violent acts.
DOXING
Regarding doxing, we have a strong stance against it. Doxing means sharing an individuals private information or aggregating public information for the purpose of intimidating them through harassment.
We connect people from all over the world. We are a global platform built on promoting a community of like-minded individuals with a desire to grow and learn together. We have no room, nor any tolerance for members, and their content, that promotes hate speech, such as calling for violence, exclusion or segregation. This includes serious attacks on people based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, age, disability, or medical conditions. This is not an exhaustive list, but we do want to be transparent about how we view these things. We understand there is a grey area between speech and action. There can be a fine line between political comments and hate speech. If you come across what you believe to be hate speech on our platforms, please take the time to report it.
If you are a victim of this behavior, and feel that your personal safety is at risk, we suggest you contact your local law enforcement immediately, in addition to reporting the behavior to us so that we may work to resolve the issue and help keep you and everyone involved safe.
We have a zero tolerance policy for behaviors that exploit minors such as grooming. Our platform requires that all members be at least 18 years of age to participate, however, we will not tolerate member created or shared content that depicts child or minor exploitation. We will report all users engaging in such activity to legal authorities.
TBL will not perpetuate or propagate misinformation, be that provided by members, or third parties. Obvious satire information should be marked as such by the creator.
You are responsible for all activity on your account. If you violate our policies we may terminate your account. Don’t do anything illegal, abusive towards others, or that abuses our site in a technical way.
You keep full ownership of all creations that you offer on TBL, but we need licenses from you to operate TBL effectively. By posting creations on our platforms you grant us a royalty-free, perpetual, irrevocable, non-exclusive, sublicensable, worldwide license to use, reproduce, distribute, perform, publicly display or prepare derivative works of your creation. The purpose of this license is strictly limited to allow us to provide and promote content and our services. We will never try to steal your creations or use them in an exploitative way. You may not post content that infringe others’ intellectual property or proprietary rights. Other members of our platforms may not use content posted by other members in any way not authorized by the creator.
You may grant TBL and our third party providers permission to access your account. This also includes Google, YouTube, Facebook, Instagram, Patreon, Twitter and the like. This is usually in the form of accessing your account on these third party platforms to allow interaction and creation of content that is cross-posted or cross-shared. An example would be granting TBL access to your Patreon account in order to create an account on our platform. At any time, you may revoke our access to those accounts by using the respective third party’s security settings. Please visit each of these platforms for more information.
Our content is protected by copyright, trademark and trade secret laws. Some examples of our content are the text on the site, articles and podcasts, images and artwork, our site’s design, colors and codebase. We grant you a license to share our content in good faith, to promote our platform, services and content, as well as your membership here. You may not otherwise use, reproduce, distribute, perform, publicly display or prepare derivative works of our content unless we give you permission in writing. Please contact us if you have any questions.
You will indemnify us from all losses and liabilities, including legal fees, that arise from these terms or relate to your use of our platform. We reserve the right to exclusive control over the defense of a claim covered by this clause. If we use this right then you will help us in our defense. Your obligation to indemnify under this clause also applies to our subsidiaries, affiliates, officers, directors, employees, agents and third party service providers.
Our platform and services are provided as-is and without warranty of any kind. Any warranty of merchantability, fitness for a particular purpose, non-infringement, and any other warranty is excluded to the greatest extent possible and permitted by law. The disclaimers of warranty under this clause also apply to our subsidiaries, affiliates and third party service providers.
To the extent permitted by law, we are not liable to you for any incidental, consequential or punitive damages arising out of these terms, or your use or attempted use of our services and platforms. To the extent permitted by law, our liability for damages is limited to the amount of money you’ve lost as a result of your use of our services and platforms. We are specifically not liable for loss associated with unfulfilled benefits and from losses caused by conflicting contractual obligations and agreements. For this clause, “we” and “our” is defined to include our subsidiaries, affiliates, officers, directors, employees, agents, and third party service providers.
We encourage you to contact us if you have an issue. If a dispute does arise out of these terms or in relation to your use of our services and platforms, then the dispute will be resolved in federal or state courts located in Arizona. Both parties consent to the exclusive jurisdiction and venue of Arizona courts for the purpose of resolving any such dispute. Arizona law, excluding its conflict of law provisions, governs these terms, all other TBL policies, and any dispute that arises between you and The Battle Lab.
These terms and any referenced policies are the entire agreement between you and us, and supersede all prior agreements. If any provision of these terms is held to be unenforceable, then that provision is modified to the extent necessary to enforce it. If a provision cannot be modified, it is severed from these terms, and all other provisions remain in force. If either party fails to enforce a right provided by these terms, it does not waive the ability to enforce any rights in the future. We may sometimes make changes to these terms and policies. If we make material changes that adversely affect your rights, then we will let you know before the changes come into effect. Continuing to use TBL after a change means you accept the new terms or policies.

Your account information, including the information you provide by using our platform and services, will be retained for as long as your account with us exists. Information collected by our third party information processing providers and payment gateways may be retained longer, per their terms and privacy policies.
We will also retain any data for any required amount of time to comply with any legal regulations, in accordance with the law.
Our members can update, modify or delete their existing account information and the content the provide through our platform at any time. This is done by logging in to our website with your account credentials, and navigating to your account link. From there, you can download and or delete your information. Please note that information stored on third party platforms, such as Stripe or Patreon will remain. Visit their websites for information on how to remove your information from their servers, as we do not have control over that.
Payment details and subscription information is retained indefinitely, however, may be deleted in due course of data cleanup, and purging of data that is over 5 years old on an as-needed basis. Once a user deletes their account, the payment details and associated information are no longer tied to a specific account.
